1. The Site
Your use of the BCIS website, www.bcis.co.uk ( the "Site") will be subject to these Terms and Conditions and the RICS Websites Terms and Conditions at www.rics.org/terms ("the Terms and Conditions") .The Site is offered to you by RICS and BCIS (BCIS is Building Cost Information Service, a commercial trading arm of RICS - The Royal Institution of Chartered Surveyors). BCIS is based at: 12 Great George Street, Parliament Square, London, SW1P 3AD, United Kingdom.

2. Acceptance of Terms and Conditions
You consent to the Terms and Conditions when you use the Site and we ask you to read these before using the Site. If you disagree with any part of the Terms and Conditions, please refrain from using the Site.

3. Copyright
The publications and data supplied by BCIS are issued only to and for the use of subscribers at the subscription address; copyright is vested with BCIS. All rights to BCIS publications and services are reserved. No part of a BCIS service or publication offered for sale may be reproduced, stored in a retrieval system, or transmitted in any form or by any means, electronic, mechanical, photo-copying, recording, or otherwise without the prior permission of the copyright owner.

4. Pricing
BCIS aims to provide the most accurate information on prices at all times. These are presented at standard rates except where a specific discount is offered. All prices are displayed in pounds sterling (£) and are subject to change without notice.

5. Privacy of Your Data
BCIS take the privacy and the security of the information you provide to us very seriously. All information you give to us is stored securely and is not accessible to other users. BCIS does not sell, trade or rent any of your personal details to any third party. We will only use the information that we collect about you lawfully and strictly in accordance with the Data Protection Act 1998. BCIS shares a common database with The Royal Institution of Chartered Surveyors (RICS) for customers who are RICS members. 6. Payment Methods
Full payment for all orders is required at the time of ordering. Payment can be by Mastercard, Visa and Maestro cards. We also accept orders using an RICS Books Credit Account. 

6.1 Pre-pay
Pre-pay items will be debited from your credit/debit card at the point of order. Please be aware that the publication date can differ to the one shown. The goods will be dispatched as soon as the product is published. 

7. VAT
Books are currently zero-rated, but many products and on-line services are subject to VAT at the standard rate. If there is any change in legislation, VAT will be applicable at the standard rate in accordance with such changes. The VAT registration number is GB 584 9400 13.

8. Despatch
8.1 All products are shipped free of charge, however we do offer a paid for premium delivery service (UK only).

Every effort is made to ensure that goods are delivered on time and the time indications provided below are subject to the goods being in stock at the time of order and may vary at certain times of the year. BCIS cannot be held responsible for any parcel not arriving within any guaranteed time due to circumstances beyond our control.

Where products are shipped free of charge, delivery will be within 3-5 working days, and despatched by most suitable method for the order. Where products have been shipped by Royal Mail then their terms and conditions are that we have to allow 15 working days for them to deliver items before they will investigate for non delivery. Online services will be available for access within 24hours of BCIS receiving the order Mon-Fri only. 

8.2 Premium delivery (UK Orders only)
You can upgrade to premium delivery at the checkout. Orders placed before 2pm Monday - Friday will be delivered the next working day by courier and will need to be signed for. If you need your order more urgently please call BCIS on 0207 695 1500. Charges for premium delivery are as follows:

£5.95 for the first item

Plus £1.20 for each additional item

8.3 Delivery to Europe
Goods will be delivered by using the most suitable method for the goods ordered by customers. A charge of £7.50 per item will be made. Delivery time for orders within Europe will vary depending on country, but will be approximately 5-10 working days.

8.4 Delivery to Rest Of The World
Goods will be delivered by using the most suitable method for the goods ordered by customers. A charge of £10.50 per item will be made. Delivery time for international orders will vary depending on country, but will be approximately 5-10 working days.

9. Returns
Goods are not normally accepted for return. Claims for non delivery must be made within 30 days from the data of the order. Claims for shortage and damage must be made within 10 working days from the date of receipt and all packaging must be retained for inspection. Claims not received within these periods may not be met. 10. Out of Stock
Customers who have placed orders for items temporarily out of stock will be informed within 14 days. These items will be recorded and supplied when available.

11. BCIS Online Services
11.1 BCIS Online Services are provided by BCIS. BCIS Online Services include the following and any similar services which may be introduced in future: BCIS Online; BCIS Review Online; BCIS Rebuild Online; BCIS Building Running Costs Online; BCIS Housing Online; BIS Construction Price and Cost Indices Online, MTC Updating Percentages Online, Price Adjustment Formulae Indices Online  ("the Service(s)"). The Services contain materials, documents and information ("Materials") from many sources and contributors ("Contributors") and is updated by BCIS from time to time.

This clause applies to the use of the Service at the subscription address by individual subscribers ('Subscribers'), by employees or companies duly authorised by an organisation which is a Subscriber or any other person authorised by RICS at the subscription address. ('Authorised Users'). References to an Unauthorised Person means any person who is neither a Subscriber nor an Authorised User or who is using the Service at an unauthorised subscription address.

Your use of the Services will be subject to these terms and conditions and the RICS websites Terms and Conditions at http://www.rics.org/terms ("the Terms and Conditions"). You consent to these Terms and Conditions when you use the Services. If you disagree with any part of the Terms and Conditions, please refrain from using the Services.

11.2 Subscription
11.2.1 A subscription is necessary to cover each Service except that the subscriber and members of the subscribers company may use the Service while off site (eg at home or a client's office) if their normal place of work is the subscription address and they are not at another office belonging to the company which does not have a separate subscription to the Service and the subscription is not at the special education rate.
11.2.2 Access to the Service via an intranet is only allowed if the subscribing company has paid for a corporate licence and provided BCIS with addresses of all company sites with access to the Service.
11.2.3 Only one person can use each subscription at a time (ie each subscription is limited to one concurrent user) unless additional concurrent users have been paid for.
11.2.4 A subscription is for an initial period of one year and can be renewed for a further period of a year. BCIS will send a renewal notice in the form of an invoice to the subscriber before the end of subscription period.  By using the LoginID and password issued to them or allowing that LoginID and password to be used or allowing access via a corporate intranet (in the case of corporate package licences) the subscriber accepts the currently published terms and conditions of the Service and agrees to pay the subscription fee. No refund of subscription fee paid can be made if the cancellation is made part way through the subscription period.
11.2.5 BCIS Online and BCIS Review Online are reciprocal services and subscribers are expected to participate by supplying information.

11.3 What you are allowed to do
Authorised Users and Subscribers during the period of their subscription may use the Services and the Materials that appear on it from time to time to support their own private study or core business activities or research, and for this purpose may:
(a) display the Materials on screen;
(b) make printouts of items included in the Materials using the printing commands contained in the Service; and
(c) download and store in machine readable form a single copy of insubstantial portions of the Materials for the Subscriber's or Authorised Users' exclusive use.

11.4 Restrictions on use
Authorised Users and Subscribers may not:
(a) access the Services from addresses other than the subscription address, whether via a network or otherwise;
(b) make multiple printouts or copies of Materials for distribution to Unauthorised Persons;
(c) re-sell the Services or any part of the Materials to others;
(d) make the Services or any Materials available to Unauthorised Persons on a local area network, a wide area network or on any intranet or extranet, without written prior permission of RICS;
(e) Forward information obtained from the Service to other unless the address receiving the information has a subscription to the Service which entitles them to receive that information;
(f) abstract, download, store, reproduce, transmit, display, copy, distribute or use the Materials other than as permitted by clause 11.3 above;
(g) use the Service or send any unsolicited promotional or advertising material, or any volume messages which may interfere with the provision of the Services or the enjoyment of the Services by other users.

11.5 Content
11.5.1  Materials and features may be added to and removed from the Services without notice.
11.5.2 The Materials and information included in the Services are provided for reference purposes only. The Services and the Materials and information it contains are not intended either as a substitute for professional advice or judgement or to provide legal or other advice with respect to particular circumstances. No responsibility for loss occasioned to any person acting or refraining from action as a result of material in this product can be accepted by any Contributor to the Services or RICS.
11.2.3 Every effort is made to keep Materials up to date but Subscribers and Authorised Users should obtain independent verification or advice before relying on any piece of information in circumstances where loss or damage may result.

11.6 Despatch
Online services will be available for access within 24hours of BCIS receiving the order Mon-Fri only.

Certain links on this Site and Services will lead to websites not under the control of BCIS. They are provided solely for your convenience and do not constitute any endorsement of any third party products or services. BCIS accepts no responsibility for any loss or damage you sustain by visiting these websites. Information held on any website not owned by RICS or BCIS does not necessarily represent the policy of BCIS or RICS and neither BCIS nor RICS take any responsibility for information given out on those sites. Any reference to commercial or trade products or methods should not be taken as an endorsement.

12. Liability
Neither BCIS, RICS nor the service providers will be under any legal liability, in respect of any mis-statement, error or omission contained therein or the reliance any person may place thereon. Information published by BCIS does not necessarily represent the policy of BCIS or the RICS nor does any reference to commercial or trade products or methods imply any endorsement of them.

13. Changes to Terms and Conditions
BCIS reserves the right to change or update the Terms and Conditions from time to time without prior notice to Users.

14. Governing Law
These terms and conditions are guaranteed by and constructed in accordance with English law with English courts having exclusive jurisdiction.
